Got him!

Rat bastard uber-Christian terrorist Eric Rudolph has been arrested.

Rudolph is wanted for several bombings, most notably the Centennial Park bombing at the Atlanta Olympics. I hope they hang the bastard.

So, will he be prosecuted as a terrorist, or do his crimes come before the more current legislation was enacted?

All his crimes pre-date the current crop of Constitution-rending terrorist laws. Rudolph has been on the run and hasn't been seen in over five years.

He faces several federal charges and murder charges in Georgia and Alabama. I believe that since one of his targets was a womens' health clinic, and somebody died there, he faces the federal death penalty. So he's pretty much dead no matter how you slice it.

He faces the death penalty in Alabama because one of his victims was an off-duty cop.

Since when has the law mattered to the current administration when it comes to getting what they want?

It's not that he dosen't deserve whatever maximum penalty is aplicable, I'm just not confident it'll be done through entirely legal methods.
